Modification Of Child Support Procedures
In General In keeping with the state’s interest in protecting the children of divorce, child support can modified or revoked before entry of a final judgment; child support established pursuant to a final judgment remains modifiable during the existence of a parent’s obligation for the support of a child. Modification often involves the filing of a petition for an increase in the amount of child support based on one or more factors constituting a substantial change in circumstances. A decrease or abatement in child support sought by the parent required to pay support is likewise appropriate under financially adverse circumstances affecting the parent’s ability to continue payment of the established child support. The following sections detail the procedures to be followed in seeking a modification of child support.
