Withholding

Income withholding has been a useful means to secure the payment of child support in Illinois for years and continues to be so.  However, the provisions effecting income withholding to secure child support have been amended and expanded by comprehensive legislation.  Other proposed changes are still pending but are likely to follow.  The bills generally were prompted by the need to bring Illinois into compliance with the mandates of the federal Personal Responsibility and Work Opportunity Reconciliation Act of 1996, Pub.L. No. 104-193, 110 Stat. 2105.  For a comprehensive discussion of the mechanisms of child support enforcement, see Chapter 4 of Volume II of IICLE’s ILINOIS FAMILY LAW SERIES.
